Terms of Service

These Terms govern your access to and use of WTN.LIVE and the services provided by xAverage Technologies Private Limited ("WTN", "we", "us"). By accessing or using the platform you agree to these Terms; if you do not agree, do not use the platform. Where you enter into a separate written agreement or order with us, that agreement governs in the event of any conflict.

WTN is a technology platform for conducting voice and other surveys and producing aggregated, structured insights. Businesses commission studies and invite their own audiences; participants take part through unique links. We provide the tools and infrastructure — we are a technology provider, not a party to the relationship, purpose, or arrangements between a business and the people or data it engages.

You must be capable of forming a binding contract and use the platform for lawful business purposes. You are responsible for the accuracy of the information you provide, for safeguarding any credentials, and for all activity conducted through your account or programmes.

You agree not to use WTN to:

• Collect data from any person without their valid, informed consent
• Engage minors without verifiable parental or guardian consent
• Violate any applicable law, including the Information Technology Act and the Digital Personal Data Protection Act, 2023
• Infringe the rights of others, or send unlawful, deceptive, harassing or harmful content
• Reverse-engineer, scrape, overload, probe, or otherwise abuse the platform, its security or its APIs
• Conduct surveys requiring legal disclosures (for example, political or regulated activities) without making those disclosures

You are solely responsible for how you use the platform and for the purposes — including any undisclosed purpose or intent — behind your use. WTN provides technology only and is not responsible or liable for the conduct, motives, or undisclosed interests of any user, or for any misuse of the platform. Where misuse, fraud, or unlawful activity occurs, responsibility rests with the party committing it. We may, at our discretion and without obligation, investigate suspected misuse, analyse relevant activity, and restrict, suspend or terminate access to protect the platform, our users, or third parties. We cooperate with, and disclose information to, law enforcement and competent authorities as required under the laws of India and the applicable state; where appropriate we may also notify or act following information received from such authorities.

Paid services are provided under the pricing set out in your order or written agreement with us. Unless that agreement states otherwise, fees are payable in advance, are exclusive of applicable taxes, and amounts for services already delivered are non-refundable. We may update pricing for future orders.

The platform, software, and our trademarks and content remain our property. A commissioning business owns its own survey questions and the aggregated insights generated from its campaigns. We may use de-identified, aggregated information that does not identify any individual to operate, secure and improve our services and models. You retain ownership of content you provide and grant us the limited rights needed to deliver the services.

The platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, and do not warrant uninterrupted or error-free operation or the accuracy or completeness of AI-generated outputs and insights, which are directional and should not be the sole basis for material decisions.

To the maximum extent permitted by law, WTN will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the services will not exceed the amounts you paid to us for the services in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless WTN, its affiliates and personnel from any claims, damages, liabilities and costs (including reasonable legal fees) arising out of your use or misuse of the platform, your content or programmes, or your breach of these Terms or of applicable law, including any claim by a third party or participant relating to your activities.

We may suspend or terminate access, with or without notice, where we reasonably believe these Terms or applicable law have been breached, or to protect the platform, our users, or third parties. You may stop using the platform at any time. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have exclusive jurisdiction, subject to any applicable arbitration agreed between us. We may update these Terms from time to time; the "last updated" date reflects the current version, and continued use after changes means you accept them.
